1. Introduction
These Terms apply to your purchase of and access to our online training videos and related materials, and our in person training sessions ("Content"). By purchasing or accessing any Content, you agree to these Terms. If you do not agree, do not purchase or use the Content.
In these Terms:
- "We/us/our" = Licensee Solutions Pty Ltd trading as AML Trainer, Western Australia.
- "You/your" = the purchaser and/or viewer of the Content.
- "Content" = videos, modules, tests, quizzes, certificates, and related educational materials.
- "Order" = your one-off purchase of access to specific video(s) or course(s).
- "CPD Point" = a Continuing Professional Development credit awarded only if you meet the stated completion requirements.
2. Orders and Access
2.1 Each Order grants you access to the specific video(s) or course(s) purchased. Your purchase is a one-off transaction and does not create an ongoing subscription unless we state otherwise at checkout.
2.2 Access is provided through our online platform. The access period and viewing limits will be as displayed at checkout or in your purchase confirmation. Access may be time-limited due to platform, licensing, content updates, or business reasons.
2.3 We may update, replace, or discontinue specific Content from time to time.
3. Training-Only Use and Non-Reliance
The Content is provided for training and educational purposes only. It is general in nature and may not suit your circumstances. You must not rely on the Content as professional advice (including medical, legal, or financial advice). You must obtain independent professional advice before acting on any information that may affect you, your clients, your employer, your business, or any third party. We do not guarantee that the Content is accurate, complete, current, or fit for any particular purpose.
4. CPD Points and Certificates
4.1 CPD Points and Certificates of Completion are available only if you meet the stated requirements for the relevant course. Unless we state otherwise, the minimum requirements are:
- Engage with (listen to/watch) the course content for at least 1 hour in total.
- Complete the assessment test and achieve a score of at least 80%.
- Comply with these Terms (including acceptable use and intellectual property restrictions).
4.2 Certificates are evidence of participation and assessment result only. They are not a professional licence, accreditation, or guarantee of competence. Recognition of CPD Points is determined by your relevant professional body or employer; we do not guarantee acceptance by any particular organisation.
4.3 We may audit completion records and withhold or revoke CPD Points and/or Certificates if we reasonably believe there has been fraud, misuse, or failure to meet requirements.
5. Intellectual Property and Licence
5.1 All intellectual property rights in the Content are owned by or licensed to us and protected by copyright and other laws.
5.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the purchased Content solely for your personal, non-commercial training and educational purposes.
5.3 You must not:
- Copy, reproduce, distribute, publish, upload, or share the Content in any form.
- Use the Content commercially (including training others for a fee, selling access, licensing, or incorporating it into paid programs).
- Record, screen-capture, download, scrape, or extract the Content unless we expressly permit it in writing.
- Modify, adapt, translate, or create derivative works from the Content.
- Remove or alter copyright notices, watermarks, or proprietary labels.
- Share your login details or provide access to anyone who did not purchase their own access.
5.4 Unauthorised use may result in suspension of access and legal action.
6. Acceptable Use
You must not:
- Use the platform unlawfully, fraudulently, or harmfully.
- Attempt unauthorised access to the platform, accounts, or systems.
- Use bots, scripts, or automated tools to access or interact with the platform.
- Interfere with the security or operation of the platform, or bypass access controls.
7. Pricing and Payments
7.1 Prices are as displayed at checkout (including applicable taxes). Payment must be made in full before access is provided.
7.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded. To the extent permitted by law, our liability for a failure to comply with a non-excludable guarantee may be limited to (at our option) supplying the services again or paying the cost of having the services supplied again.
8. Disclaimers and Limitation of Liability
8.1 To the maximum extent permitted by law, we provide the Content and platform "as is" and "as available" without warranties of any kind. We are not liable for any loss or damage arising from your access to or use of the Content or platform, including indirect or consequential loss, loss of profit, loss of business, or loss of data.
8.2 To the maximum extent permitted by law, our total aggregate liability to you in connection with any Order is limited to the amount you paid for that Order.
9. Indemnity
You agree to indemnify us from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful conduct, or your unauthorised use of the Content.
10. Suspension or Termination of Access
We may suspend, restrict, or terminate your access to the platform and/or Content immediately if we reasonably believe you have breached these Terms (including misuse of intellectual property or sharing access). Termination does not affect any rights we may have against you, including for breach of intellectual property rights.
11. Privacy
We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles. If you do not agree with our handling of personal information, do not use the platform.
12. Changes to These Terms
We may update these Terms by publishing an updated version on our website/platform. Updated Terms apply to purchases made after publication. For existing Orders, the Terms in effect at the time of purchase generally apply, unless the change is required by law or relates to security, fraud prevention, or platform integrity.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Western Australia. You submit to the exclusive jurisdiction of the courts of Western Australia and courts competent to hear appeals from those courts.
